Terms of Service

This page is maintained by Smoothbook to set out the terms for using our platform. In addition to these Terms, businesses who use Smoothbook may maintain their own terms, which we encourage you to review before creating an account or booking appointments with them.

1. Acceptance of these terms

By creating an account or otherwise using Smoothbook (the “Service”), you agree to these Terms of Service, our Privacy Policy and our Cookie Policy. If you do not agree, do not use the Service.

2. The Service

Smoothbook is an online appointment-booking platform that lets service businesses publish availability and take bookings, and lets customers book and manage appointments. We may update, add, or remove features from time to time to improve the Service.

3. Accounts & eligibility

  • You must provide accurate information and keep your account secure.
  • You are responsible for activity that happens under your account.
  • You must be old enough to form a binding contract in your country to use the Service.
  • Notify us promptly of any unauthorised use of your account.

4. Acceptable use

You agree not to:

  • break the law or infringe others’ rights when using the Service;
  • upload malicious code or attempt to disrupt or gain unauthorised access;
  • misuse personal data you access through the Service;
  • resell or copy the Service without our permission.

5. Businesses and customers

When a business uses Smoothbook to manage its bookings, that business is responsible for its own services, pricing, cancellation rules and for handling its customers’ data lawfully (it is the data controller; Smoothbook is its processor). Customers are responsible for the accuracy of the booking details they provide and for honouring the booking terms set by the business they book with.

6. Payments & fees

Paid plans and any platform fees are described at the point of purchase. Payments are processed by our payment provider; we do not store full card details. Where a business takes payment from its customers through the Service, that transaction is between the business and the customer. Fees already paid are non-refundable except where required by law.

7. Intellectual property

Smoothbook and its software, branding and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms. Content you submit remains yours; you grant us the rights needed to operate the Service.

8. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Smoothbook is not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

9. Termination

You may stop using the Service and delete your account at any time from your account page. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Some provisions (such as payment, intellectual property and liability) survive termination.

10. Changes to these terms

We may update these Terms from time to time. If we make material changes we will take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of New York in the United States of America, without regard to conflict-of-laws rules.
